Life
imprisonment implies a jail term for the convict’s entire life, the
Supreme Court has held, clearing a misconception on this sentence.
The apex court also said that
its Constitution bench’s landmark judgement of 1980 on criterion for
imposing death penalty needs a “fresh look” as there has been “no
uniformity” in following its principles on what constitutes “the
rarest of rare” cases.
“It appears to us there is a
misconception that a prisoner serving a life sentence has an
indefeasible right to be released on completion of either fourteen
years or twenty years imprisonment. The prisoner has no such right.
“A convict undergoing life
imprisonment is expected to remain in custody till the end of his
life, subject to any remission granted by the appropriate
government,” a bench of Justices K.S. Radhakrishnan and Madan B.
Lokur said.
The bench, however, clarified
that under remission the appropriate government cannot reduce the
period of sentence less than 14 years for a life convict.
“In the case of a convict
undergoing life imprisonment, he will be in custody for an
indeterminate period. Therefore, remissions earned by or awarded to
such a life convict are only notional. In his case, to reduce the
period of incarceration, a specific order under Section 432 of the
CrPC will have to be passed by the appropriate government. However,
the reduced period cannot be less than 14 years as per Section 433-A
of the CrPC,” the apex court said.
The apex court order also seeks
to put an end to the practice of en-masse release of the convicts by
various governments on “festive” occasions and said each release
requires a case-by-case basis scrutiny.
The Supreme Court has ruled that in murder
cases the convict sentenced to life imprisonment cannot claim any
automatic right to be released after serving a minimum 14 years
sentence, except under extraordinary Constitutional provisions.
The apex court further held that in case of life imprisonment, a
convict should serve a minimum of 14 years imprisonment.
A bench of Justices Altamas Kabir and Cyriac Joseph made the remarks
while directing Chattisgarh government to ensure that the convict
Ramraj sentenced to life imprisonment serves at least a minimum of
20 years.
"In the various decisions rendered after the decision in Godse's
case, 'imprisonment for life' has been repeatedly held to mean
imprisonment for the natural life term of a convict, though the
actual period of imprisonment may stand reduced on account of
remissions earned.
"But in no case, with the possible exception of the powers vested in
the President under Article 72 of the Constitutition and the power
vested in the Governor under Article 161 of the Constitution, even
with remission earned can a sentence of imprisonment for life be
reduced to below 14 years," the apex court said.
The apex dismissed the appeal of Ramraj who had claimed that he was
entitled to be released after 14 years on after computing the period
of remission granted to him.

है उम्रकैद का मतलब ?
नई दिल्ली ॥ उम्रकैद की सजा का मतलब ताउम्र कैद ही होता है, लेकिन
सरकार मुजरिम के चाल-चलन के आधार पर 14 साल की कारावास काटने के बाद उसे
माफी दे सकती है। जेल मैन्युअल के मुताबिक जब सजायाफ्ता 14 साल की सजा
काट लेता है तो जेल प्रशासन उसके चाल-चलन के आधार पर उसके केस को
सेंटेंस रिव्यू कमिटी के पास भेजता है। कमिटी अगर समझती है कि सजायाफ्ता
की बाकी सजा माफ की जानी चाहिए, तो वह अपनी अनुशंसा लेफ्टिनेंट गवर्नर
के पास भेजती है और फिर मुजरिम की बाकी की सजा माफ होती है। लेकिन यह
सब सरकार का विशेषाधिकार है।
कानूनी जानकारों के मुताबिक, आईपीसी की धारा-45 में कहा गया है कि
उम्रकैद का मतलब सारी उम्र कैद होती है। 1955 से पहले हत्या जैसे संगीन
मामलों में दोषी करार दिए जाने के बाद फांसी या कालापानी की सजा का
प्रावधान था। यह भी ताउम्र की सजा थी। लेकिन 1955 में आईपीसी की
धारा-53 में संशोधन किया गया और कालापानी को उम्रकैद में बदल दिया गया।
1961 में गोपाल विनायक बनाम स्टेट ऑफ महाराष्ट्र के केस में सुप्रीम
कोर्ट के सामने पहले बार यह सवाल उठाया गया कि उम्रकैद का मतलब क्या
है। याचिकाकर्ता ने सरकार द्वारा सजा में छूट दिए जाने के प्रावधानों
का हवाला देते हुए कहा कि वह 20 साल की सजा काट चुका है इसलिए उसे छोड़ा
जाना चाहिए। इस पर सुप्रीम कोर्ट की संवैधानिक बेंच ने कहा कि सजा में
छूट का फायदा तभी होगा, जब सरकार उम्रकैद की सजा को सीआरपीसी की
धारा-433 के तहत किसी विशेष अवधि की सजा में तब्दील कर दे।
सीआरपीसी की धारा-432 में प्रावधान है कि सरकार सजा में छूट (रेमिशन)
दे सकता है और 433 में प्रावधान है कि सजा में बदलाव (कम्यूट) कर सकता
है। लेकिन इस प्रावधान के तहत सरकार की ओर से कुछ मनमानी हुई और कई लोगों
की उम्रकैद कम कर उसे माफी दे दी गई। इसके बाद 1978 में सीआरपीसी में
बदलाव हुआ और धारा-433 (ए) के तहत प्रावधान किया गया कि सरकार उम्रकैद
को 14 साल से कम नहीं कर सकती। इसके बाद 1978 में मेरू राम बनाम यूनियन
ऑफ इंडिया के केस में याचिकाकर्ता ने सीआरपीसी की धारा-433 (ए) के
प्रावधानों को चुनौती दी। तब सुप्रीम कोर्ट के संवैधानिक बेंच ने कहा
कि सीआरपीसी का बदलाव कानून संगत है। अदालत ने कहा कि उम्रकैद का मतलब
ताउम्र कैद है लेकिन सरकार अगर चाहे तो उम्रकैद की सजा को 14 साल कर
सकती है और 14 साल सजा काट चुके सजायाफ्ता की बाकी की सजा में छूट देकर
उसे रिहा कर सकती है। वहीं संविधान के अनुच्छेद 72 में राष्ट्रपति को,
जबकि अनुच्छेद 161 में राज्यपाल को अधिकार है कि वह किसी भी सजायाफ्ता
या मुजरिम की सजा को किसी भी वक्त माफ कर सकता है।
